These terms govern your use of bingeclub.live. By reading the site you accept them. If you do not accept them, the remedy is simple: stop using the site.
1. Who we are
BingeClub publishes editorial writing about streaming and film. The site is operated by BingeClub and can be reached at [email protected].
2. Use of the site
You may read, quote and link to anything here. You may not copy substantial portions of an article and republish them as your own work, scrape the site at volume, or use automated tools in a way that degrades service for other readers. Personal, non-commercial quoting with attribution and a link is always welcome.
3. Intellectual property
All editorial text on this site is the intellectual property of BingeClub and its writers, protected by copyright law. Titles, trademarks, logos and promotional artwork belonging to streaming services, studios or rights holders remain the property of their owners and are used for identification and commentary only. Photographic material is drawn from openly licensed or public domain sources and is credited where the licence requires it.
4. Acceptable use
When commenting or contacting us you agree not to post material that is unlawful, defamatory, harassing, hateful, or that impersonates another person. You agree not to post spam or commercial solicitation. We may remove any comment and block any participant at our discretion, without notice, and we are not obliged to explain a decision.
5. Third-party links and affiliate relationships
The site links to streaming services, retailers and other websites. We do not control those destinations and we are not responsible for their content, their availability, their pricing or their terms. Some links are affiliate links, meaning we may earn a commission if you sign up through them, at no extra cost to you. This is disclosed on the pages concerned and on our About page. A commission never determines whether a title is covered, how it is ranked, or what verdict it receives.
6. No professional advice
Everything published here is opinion and commentary for general reading. It is not legal, financial or technical advice, and it is not a recommendation to enter into any contract. Decisions about subscriptions, spending or equipment are yours.
7. Accuracy and availability of information
Streaming catalogues change constantly and licences expire without warning. We check availability as carefully as we can at the time of writing, but we cannot promise that a title is still streaming on a given service, in a given country, on the day you read about it. We correct errors when readers point them out and we would rather you told us than quietly stopped reading.
8. Disclaimer of warranties
The site is provided on an as-is and as-available basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or free of errors.
9. Limitation of liability
To the fullest extent permitted by law, BingeClub and its writers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or subscription value, arising out of your use of the site or your reliance on anything published here. Where liability cannot lawfully be excluded, our total aggregate liability is limited to the amount you have paid us, which for ordinary readers is nothing.
10. Indemnification
You agree to indemnify and hold harmless BingeClub, its writers and its operators against any claim, loss, liability or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the site.
11. Confidentiality
If we correspond privately, for example about a correction before publication, we will treat the contents of that correspondence as confidential and will not publish it without your agreement, unless we are required to disclose it by law.
12. Termination
We may suspend or end your access to commenting, or to the site as a whole, at any time and without notice if we believe these terms have been breached. The sections on intellectual property, disclaimers, limitation of liability, indemnification and governing law survive any such termination.
13. Governing law and disputes
These terms are governed by the laws of the State of California, in the United States, without regard to conflict of law principles. Any dispute that cannot be resolved informally will be subject to binding arbitration in California, and to the exclusive jurisdiction of the state and federal courts located in California for any matter that arbitration cannot resolve. Before filing anything, write to [email protected] so that we have a fair chance to resolve the matter directly.
14. Changes to these terms
We may update these terms from time to time. The date at the top of the page will change when we do. Continuing to use the site after a change means you accept the revised terms.
